3. HIPAA & Protected Health Information (PHI)

As a healthcare provider, our collection, use, and disclosure of your Protected Health Information (PHI) are governed by the Health Insurance Portability and Accountability Act (HIPAA). 5. The "Shield" Clause: Strict Non-Disclosure (Carrier Mandated)

Bright Care Family Medicine Corp maintains a strict policy regarding your mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties under any circumstances. We do not sell, rent, or lease our patient lists or mobile data to third parties.

6. Disclosure to Third-Party Service Providers

We utilize "Business Associates" (e.g., our communication platform Weave, billing processors, or IT software) to facilitate your care. All such third parties are legally bound by Business Associate Agreements (BAAs) as required by HIPAA and are prohibited from using your information for any purpose other than providing services to our Practice.

7. Data Security & Limitation of Liability

We implement administrative, technical, and physical safeguards (including SSL encryption) to protect your data. However:

  • No Guarantee: You acknowledge that no data transmission over the internet or mobile network is 100% secure.
  • Liability Cap: To the maximum extent permitted by law, Bright Care Family Medicine Corp shall not be liable for any unauthorized access to your information resulting from security breaches on your personal devices, email accounts, or carrier networks.

8. Mandatory Indemnification

By using our website and communication services, you agree to indemnify and hold harmless Bright Care Family Medicine Corp, its officers, directors, and employees from any claims, losses, or damages (including legal fees) arising from:

These Terms of Use ("Terms") govern your access to and use of the website and related online services operated by Bright Care Family Medicine Corp, doing business as Bright Care Medical Group and Bright Care Family Medicine ("Bright Care," "we," "us," or "our"), including all pages, content, features, functionality, and links made available through the website (the "Site"). Do not use the Site, general email, standard text messaging, WhatsApp, or other non-emergency contact methods for urgent or time-sensitive issues.

If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room. If you are experiencing a mental health crisis or need immediate emotional support, call 988 or seek emergency assistance immediately.

We do not guarantee immediate review of messages sent through website forms, general email, text, WhatsApp, or other informal communication channels.

Bright Care is not responsible for the availability, content, security, accuracy, functionality, or privacy practices of third-party websites, services, or platforms.

When you leave our Site or use a third-party scheduling or communication service linked through the Site, you do so at your own discretion and subject to that third party's terms.

6. Communications Through the Site

The Site may provide phone numbers, email addresses, text-enabled numbers, and messaging pathways for administrative convenience. By contacting us through these channels, you acknowledge and agree that:

  • general communications may not be secure in the same way as a patient portal or other designated clinical communication system
  • such channels may not be appropriate for sensitive, urgent, or emergency communications
  • Bright Care may decline to address clinical matters through informal communication channels and may require you to call the office, use an authorized platform, schedule an appointment, or seek emergency care as appropriate

You agree not to send highly sensitive personal, financial, insurance, or medical information through general website communication methods unless expressly instructed by us through an approved process.

7. Text Messaging and Mobile Communications

Bright Care may offer text messaging for administrative, informational, care-coordination, scheduling, patient service, and, where separately authorized, promotional or marketing purposes.

By voluntarily providing your mobile number and opting in through a valid consent mechanism, you agree to receive text messages from Bright Care at the number you provided, subject to your consent and applicable law.

Your consent to receive text messages is not a condition of purchasing any goods or services or receiving care, except where a text message is strictly necessary to fulfill a request you initiated.

Message frequency may vary depending on your interaction with Bright Care, your appointments, your requests, and the messaging program for which you enrolled. Message and data rates may apply.

You may opt out of text messages at any time by replying STOP to any text message you receive from us. You may also revoke consent by using another reasonable method that clearly communicates your request to stop receiving texts from us. After we process your opt-out, you may receive one final text message confirming that you have been unsubscribed. No further non-exempt text messages will be sent after that confirmation unless you provide new consent.

8. Eligibility and Acceptable Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • use the Site in violation of any applicable law, regulation, or third-party right

Bright Care is not required to use, display, or maintain any submission and may remove or disregard submissions at its discretion.

To the fullest extent permitted by law, Bright Care disclaims all express or implied warranties of any kind regarding the Site, including warranties of accuracy, completeness, availability, reliability, noninfringement, merchantability, and fitness for a particular purpose.

We do not warrant that the Site will be uninterrupted, error-free, secure, free of harmful code, or that defects will be corrected.

To the fullest extent permitted by law, Bright Care Family Medicine Corp d/b/a Bright Care Medical Group and Bright Care Family Medicine, and its owners, officers, directors, employees, contractors, agents, licensors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your access to, use of, inability to use, or reliance on the Site or any content or third-party links made available through the Site.

To the fullest extent permitted by law, Bright Care's total liability for any claim arising out of or relating to the Site or these Terms shall not exceed one hundred U.S. dollars ($100).

Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.

You agree to defend, indemnify, and hold harmless Bright Care Family Medicine Corp d/b/a Bright Care Medical Group and Bright Care Family Medicine, and its owners, officers, directors, employees, contractors, agents, licensors, and affiliates, from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

If there is a conflict between these Terms and our HIPAA Notice of Privacy Practices with respect to protected health information governed by HIPAA, the HIPAA Notice of Privacy Practices will control to the extent required by law.

No waiver by Bright Care of any term, condition, or breach of these Terms shall be deemed a further or continuing waiver of that term, condition, or breach or any other term, condition, or breach.

These Terms, together with any documents expressly incorporated by reference, constitute the entire agreement between you and Bright Care regarding the Site and supersede all prior or contemporaneous understandings regarding the Site.
